What Is Form 1099 NEC?

Who Gets a 1099 NEC?
If you paid an individual, a partnership, or a single member LLC $600 or more for 2025 work, or $2,000 or more for 2026 work, that person or business generally receives a 1099 NEC. How to Fill Out a 1099 NEC
Here's the box-by-box process, cross-checked against the IRS instructions.
Step 1: Collect a completed Form W-9 before you pay the contractor
Ask for this before the first invoice is paid, not after. The W-9 gives you the contractor's legal name, address, entity type, and taxpayer identification number.
Step 2: Enter payer information
Your business name, address, and taxpayer identification number go in the payer fields at the top of the form.
Step 3: Enter recipient information
Pull the contractor's name, address, and taxpayer identification number directly from their W-9.
Step 4: Report the total in Box 1a
Enter total nonemployee compensation paid during the calendar year. If cash tips, a tipped occupation, or overtime compensation apply, complete Boxes 1b through 1d as well.
Step 5: Complete Box 4 if backup withholding applied
If you withheld federal income tax because the contractor did not provide a valid taxpayer identification number, report that amount here.
Step 6: Complete the state boxes if applicable
Boxes 5 through 7 cover state tax withheld, the payer's state identification number, and state income, needed if your state participates in combined federal and state filing.
Step 7: Distribute the copies
Copy A goes to the IRS. Copy B goes to the recipient. Copy 1 goes to the state tax department if required. Copy C stays in your own records for at least four years.
How to File and Where to Send Each Copy
The deadline for Form 1099 NEC sits earlier than most other 1099 forms, and that catches people off guard every single year. Copy B has to reach the recipient by January 31. Copy A has to reach the IRS by January 31 as well, whether you file on paper or electronically. There is no extended window here the way there is for some other information returns.
